Terms of Service

1. Who we are

RealTells ("RealTells", "we", "us") is an online service available at realtells.com. RealTells is operated by Samat Makatov, individual entrepreneur “Makatov Digital”, 27/1 Baitursynov St., office 201, Almaty, Republic of Kazakhstan. These Terms are a contract between you and Samat Makatov, individual entrepreneur “Makatov Digital” (the "Operator"), trading as RealTells. You can contact us at support@realtells.com.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles payment-related enquiries and processes refunds. Paddle's Buyer Terms also apply to your purchase.

By creating an account, uploading photos or buying credits you agree to these Terms. If you do not agree, do not use RealTells.

2. What RealTells does

RealTells is software. You upload photos of an item such as a handbag, a pair of shoes or an accessory. Our system uses several artificial intelligence (AI) models to examine the photos, compares visible details with reference examples and known patterns, and produces a written report. The report lists the findings that point towards and against authenticity, explains what could not be checked, and gives an overall opinion — "Likely authentic", "Inconclusive" or "Not verified — inconsistencies found" — with a confidence level.

Reports are generated by AI. We may change the models, data sources and methods we use at any time to improve the service.

3. What a report is — and what it is not

• A report is an opinion, not a guarantee. It is based only on the photos you provide and on the information available to us at the time.
• It is not a physical inspection. Some replicas cannot be distinguished from authentic items in photos, and some authentic items have unusual features. Image quality, lighting, editing and missing angles all limit what can be seen.
• It is not issued by any brand. RealTells is independent and is not affiliated with, endorsed by or sponsored by any brand. Brand names are used only to identify products.
• It describes the photos, not a specific physical object. We cannot confirm that the photos show the item you buy, sell or hold.
• A report is not legal, financial or valuation advice and is not proof for courts, customs, insurers or marketplaces unless they decide to accept it.

You decide what to do with a report. Use it as one input among others, especially for high-value purchases.

4. Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, to use RealTells and buy credits. You are responsible for your account and for keeping your login details safe. Tell us promptly if you believe your account has been used without your permission.

5. Credits, prices and payment

• Reports are paid with credits. Prices are shown on our Pricing page and at checkout. Taxes are calculated by Paddle at checkout.
• Credits are units of use of the RealTells service and can only be spent on RealTells reports. They are not money, e-money or store credit, have no cash value, cannot be transferred, sold or withdrawn, and can be refunded only as described in the Refund Policy. Purchased credits are valid for 24 months from the date of purchase.
• The Pro plan is a monthly subscription billed by Paddle until you cancel via the link in your Paddle receipt. Monthly Pro credits that are not used within the month do not roll over.
• We may change prices for future purchases. Changes do not affect credits you have already bought.

6. Refunds

Refunds are described in our Refund Policy, which is part of these Terms. Nothing in these Terms limits rights you have under mandatory consumer protection law.

7. Your photos and content

• You keep ownership of the photos and information you upload ("Your Content").
• You give us a worldwide, non-exclusive, royalty-free licence to store, copy, process and analyse Your Content, including by sending it to our AI model providers, in order to provide the service to you, to keep it secure and to meet legal obligations.
• We will use Your Content to improve our models and reference data only if you agree to this separately. You can withdraw that agreement at any time in your account or by email.
• You confirm that you have the right to upload Your Content and that it does not infringe anyone's rights.

8. Acceptable use and moderation

You agree not to:

• upload photos you do not have the right to use, or photos of a different item than the one you present the report for;
• upload unlawful content, malware, or images of other people or their personal documents;
• use RealTells to make or improve replica goods, or to help sell them;
• present a report as a guarantee, a brand certificate or proof of authenticity of a physical item, or alter a report;
• use a report to harass, threaten or defame a seller or any other person;
• scrape, reverse engineer, overload or try to bypass the safeguards of the service, or access it by automated means except through an interface we provide to you;
• break any law or the rights of others.

We may refuse to process content, remove content, decline to produce a report, or suspend or close accounts where needed to prevent abuse or legal risk.

Intellectual property notices. Rights holders can send notices to support@realtells.com (subject "IP notice"). We remove infringing content and close the accounts of repeat infringers.

9. Shared reports

Reports are private by default. If you share a report link, anyone with the link can see the report and the photos it is based on. A shared report shows the date it was produced and that it is an AI-generated opinion based on submitted photos. You can turn sharing off at any time.

A shared report is information for the person viewing it, not a guarantee to them. We owe duties only to the customer who ordered the report.

10. Availability and changes

We aim to keep RealTells available and to deliver reports in minutes, but we do not guarantee uninterrupted service or a specific delivery time. We may change or discontinue features. If we stop the service, we will give at least 30 days' notice and refund unused paid credits that are still valid.

11. Intellectual property

The RealTells software, website, report format and the content we create belong to the Operator. You may use and share your own reports for personal purposes and when buying or selling an item, as long as you share the full report with its date and disclaimer and do not alter it. All third-party trademarks belong to their owners.

12. Disclaimers

To the extent permitted by law, RealTells is provided "as is" and "as available". We do not promise that reports will be correct in every case, that every replica will be detected, or that an item reported as likely authentic is authentic. You are responsible for decisions you make based on a report.

13. Limitation of liability

To the extent permitted by law, the Operator is not liable for indirect or consequential losses, including the price paid for an item, lost profits or lost opportunities, and the Operator's total liability for any claim relating to RealTells is limited to the greater of (a) the amount you paid us in the 12 months before the claim and (b) USD 100. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, for fraud, or your statutory rights as a consumer.

14. Termination

You can stop using RealTells and ask us to delete your account at any time. We may suspend or end your access if you break these Terms. Sections that by their nature should continue (for example 3, 7, 9, 11–13 and 15) survive termination.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of Kazakhstan. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim in the courts there. Please contact us first — most issues can be solved by email.

16. Changes to these Terms

We may update these Terms. We will post the new version on this page with a new date and, for important changes, notify registered users by email before they take effect.
